Offenders should be punished publicly

Chapter Nuur” – (Light) - 24

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.
 (I seek refuge in Allaah from Satan the outcast)

Bis-Millaahir-Rah-maanir-Rahiim.

(In the name of Allaah, the Beneficent, the Merciful)

 ٱلزَّانِيَةُ وَٱلزَّانِى فَٱجْلِدُوا۟ كُلَّ وَٰحِدٍ مِّنْهُمَا مِا۟ئَةَ جَلْدَةٍ وَلَا تَأْخُذْكُم بِهِمَا رَأْفَةٌ فِى دِينِ ٱللَّهِ إِن كُنتُمْ تُؤْمِنُونَ بِٱللَّهِوَٱلْيَوْمِ ٱلْءَاخِرِ وَلْيَشْهَدْ عَذَابَهُمَا طَآئِفَةٌ مِّنَ ٱلْمُؤْمِنِينَ 2  

2b.  And let not pity for the twain withhold you from obedience to Allah, if ye believe in Allah and the Last Day; and let a party of believers witness their punishment.
2b.  Wa  laa  ta’-khuzkum-  bihimaa  ra’-fatun  fii  DiiNillaahi  ‘in  kuntum  tu’-minuuna  Billaahi  wal-Yaw-mil-‘Aakhir.  Wal-yash-had  ‘azaaba-humaa  taaa-‘ifatum-minal-  Mu’-miniin.

Commentary

It is commanded: Punishment for adulterer and adulteress has been fixed one hundred stripes for each of the both according to Religious and Legislative Law. And which way of living in the world Allaah Almighty has determined for the mankind, with regard to that, punishing to such criminals is compulsory. Therefore, when the criminal act is proved, then no argument or trick for forgiving the punishment can be acceptable. No one should feel pity for any of the criminals and nor any person should show any favor due to their wealth, property, influence or relationship. If you believe in Allaah Almighty and in the Day of Resurrection, then you should give punishments; prescribed by Allaah Almighty in the world to the wrongdoers without hesitation, favor and partiality. The offenders should not be punished secretly but before the people, because it is necessary to warn them that such evildoers will be whipped before the entire people publicly, that haply they avoid doing such works, by looking their punishment and disgrace.

Common punishment of fornication has been described in this verse. Vile act as adultery can be committed by unmarried male and female only. After marriage, it cannot be thought in Islamic Society. Therefore, if any married man or woman has been involved in such kind of error, it would be unusual and rare condition and its punishment also would be more severe.
